These Terms govern your use of soldforwhat.com.au (the "Platform") as a player, operated by SoldForWhat Pty Ltd ACN 697 151 170 ("we", "us", "our"). By using the Platform you agree to these Terms. Real estate agents and agencies: separate Agent Terms apply to the agent portal.

1. What the Platform does

SoldForWhat is a Toowoomba-focused daily price-guessing game. Each day we feature a real local property and reveal its sold price after you guess. Sold-price data is provided by local selling agents. The Platform is operated from Queensland, Australia.

2. Playing and your account

Anyone can play the daily game for free without an account. You can optionally create a free account to appear on the leaderboard and track your stats. When you sign up you choose a display name, shown publicly on the leaderboard alongside your score — please don't use an offensive name or impersonate anyone. We don't publish your email, last name or other contact details. We may remove leaderboard entries or display names we believe are offensive, fraudulent, automated, or otherwise in breach of these Terms.

You agree not to:

• scrape, copy, mirror or systematically extract Platform content;
• submit false information or impersonate another person;
• use any form on the Platform to send unsolicited commercial messages;
• upload abusive, defamatory or unlawful content;
• attempt to circumvent authentication, rate limits or other security controls.

You must be 13 or older to create an account. If you are under 18, please get a parent or guardian's permission to use SoldForWhat.

3. Sold-price data and accuracy

The sold prices shown are provided by local selling agents and are not sourced from official Title or Valuation Office records. While we review submissions, we do not independently verify every sale. Treat the data as informational and for entertainment only — do not rely on it as the sole basis for any legal, valuation, financial or purchasing decision. Always obtain independent professional advice before acting on a property decision.

4. Pricing

The Platform is free to use. There is no fee to play the daily game or create a player account. If we introduce any paid features in future, we will update these Terms and give reasonable notice before any charge applies to you.

5. Intellectual property

The Platform — including its design, code, branding (SOLDFORWHAT? word mark and logo), database structure and the daily game format — is owned by SoldForWhat Pty Ltd and may not be reproduced without permission.

6. Privacy

Personal information is collected, used and disclosed in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). The Privacy Policy forms part of these Terms.

7. Disclaimers and liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

Subject to that, the Platform is provided "as is" and "as available". To the maximum extent permitted by law:

• we exclude all implied warranties about accuracy, completeness, fitness for purpose or uninterrupted availability;
• as the Platform is free to players, our total aggregate liability to you for all claims arising out of or in connection with it is limited to AUD $100, except where a consumer guarantee applies and cannot be excluded, in which case our liability is limited to resupplying the relevant service;
• we are not liable for indirect, consequential or business loss, including loss of profits, reputation or opportunity.

8. Changes to these Terms

We may update these Terms from time to time. Changes are published on this page with the "Last updated" date and Version revised. Your continued use of the Platform after the effective date constitutes acceptance.

9. Governing law

These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.

10. Force majeure

We are not liable for failure or delay caused by circumstances beyond our reasonable control, including power or telecommunications failures, natural disasters, government action, or failure of third-party infrastructure or services we rely on.

11. General

If any provision of these Terms is found invalid or unenforceable, it is severed to the minimum extent necessary and the rest continues in force. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding your use of the Platform as a player. Only SoldForWhat Pty Ltd, acting through its directors, may vary these Terms.

12. Dispute resolution

If you have a concern or dispute, please contact us first at hello@soldforwhat.com.au and we'll try to resolve it reasonably. Nothing prevents either party from seeking urgent relief from a court.
